KUCERA Transactions & Finance Partners Andre Barth and Oliver Platt, LL.M (UW Madison) have contributed to the 3rd edition of the distressed debt industry standard book “Grundlagen des NPL-Geschäfts” („Fundamentals of NPL Business“), published by Frankfurt School Verlag. The topic is due diligence in the acquisition of non-performing loans. Both are “NPL veterans” from the legal department of Hudson Advisors, the exclusive servicer of Lone Star Funds, and members of the interdisciplinary KUCERA internal “NPL Hub”, which combines distressed debt advisory competencies in transactional, workout (including enforcement and litigation) and tax structuring.
The book describes the legal basis of the NPL business in terms of the (European) regulatory framework, data protection requirements and insolvency law. In addition, the process of NPL transactions is described and various aspects of the NPL market are explained. Innovations in the NPL business due to digitalization are also covered; the presentation of sample contracts complete the contents of the book.
